La decisione è del giudice Valerio Di Gioia, il quale ha invece inviato al presidente del Tribunale Paolo De Fiore gli atti relativi alla posizione del secondo imputato, Yassir Goretz, 33 anni, responsabile della sicurezza di Rifondazione Comunista, imputato per resistenza e lesioni a pubblico ufficiale, partecipazione a manifestazione non autorizzata e danneggiamento.

    Goretz ha scelto il giudizio ordinario, ma il giudice Di Gioia, essendosi pronunciato sulla posizione di Bauml, ha dovuto astenersi e rinviare gli atti al presidente del Tribunale, il quale ora dovra’ o confermare che Di Gioia può processare anche Goretz oppure scegliere un altro giudice. Il 18 dicembre è stata fissata la nuova udienza nel corso della quale si conosceranno le decisioni.
